1. OUR SERVICES
Kawaii Stop provides an online retail store offering fashion, accessories, cosplay items, collectibles, lifestyle products, and related goods.

4. USER REPRESENTATIONS

- You have the legal capacity to agree to these Terms;
- You will not access the Services through automated or non-human means, including bots, scripts, scrapers, or similar tools;
- You will not use the Services for any fraudulent, illegal, abusive, or unauthorized purpose;
- You will not submit false claims, false disputes, false chargebacks, false return requests, or misleading information; and
- Your use of the Services will comply with all applicable laws and regulations.
If any information you provide is inaccurate, incomplete, fraudulent, misleading, or outdated, we may suspend or terminate your account, cancel orders, refuse service, or pursue remedies available under these Terms and applicable law.
5. USER REGISTRATION
You may be required to create an account to use certain parts of the Services.
You are responsible for maintaining the confidentiality of your account login information and for all activity that occurs under your account.
You agree to notify us immediately if you believe your account has been accessed without authorization.
We reserve the right to remove, reclaim, or change a username, suspend an account, or terminate access if we determine, in our sole discretion, that the account is inappropriate, misleading, abusive, fraudulent, inactive, or otherwise violates these Terms.
6. PRODUCTS
We make reasonable efforts to display product descriptions, colors, images, sizing, specifications, prices, and availability accurately. However, we do not guarantee that all product descriptions, images, colors, details, measurements, or availability information will be accurate, complete, reliable, current, or error-free.
Product images are illustrative. Actual colors, textures, sizing, patterns, packaging, materials, and appearance may vary due to lighting, screen settings, manufacturing differences, supplier updates, restocks, product batches, photography, or other factors.
Minor variations in color, sizing, material, packaging, labeling, stitching, trim, print placement, shade, shape, or appearance do not automatically constitute a defect.
All products are subject to availability. We may limit quantities, discontinue products, correct product information, update pricing, or cancel orders where necessary.
We reserve the right to correct pricing, typographical, inventory, shipping, discount, or product errors at any time, including after an order is placed. If payment has already been captured and the order cannot be fulfilled under the corrected terms, we may cancel and refund the affected order.
7. PURCHASES AND PAYMENT
We accept payment methods displayed at checkout, which may include major credit cards, debit cards, PayPal, Shop Pay, or other payment options made available through the Services.
By placing an order, you agree to pay all charges associated with your purchase, including:
- Product prices;
- Shipping charges, if applicable;
- Taxes, duties, or fees, if applicable;

You authorize Kawaii Stop LLC and our payment processors to charge your selected payment method for all amounts due.

All payments are processed in U.S. dollars unless otherwise stated.
8. SHIPPING, DELIVERY, CUSTOMS, AND REFUSED DELIVERIES
Shipping and processing are governed by our Shipping Policy, which is incorporated into these Terms by reference.
Processing time refers to the time needed to prepare, source, package, verify, or fulfill an order before shipment.
Shipping time refers to the estimated transit time after the carrier or logistics provider receives the package.
Processing and shipping timelines are estimates and are not guarantees unless expressly stated otherwise in writing.
Delivery is considered complete when the carrier, postal service, logistics provider, tracking service, or delivery confirmation marks the shipment as delivered to the address provided at checkout.
Once delivery is confirmed, responsibility for the package transfers to the customer, including risk of loss, theft, damage after delivery, missing package claims, or inability to retrieve the package, unless an approved shipping protection plan applies.
Customers are responsible for providing a complete and accurate shipping address. Address errors, missing apartment numbers, incorrect postal codes, forwarding issues, refusal of delivery, failure to pick up a package, or local delivery problems may result in delays, failed delivery, return shipping, additional fees, or loss of refund eligibility.
International orders may be subject to customs duties, taxes, import fees, brokerage fees, inspection delays, customs holds, or other government charges. These charges are the customer’s responsibility unless otherwise stated.
If an order is refused, abandoned, rejected, returned, delayed, seized, destroyed, or not delivered due to unpaid customs fees, import restrictions, incomplete address information, customer refusal, failure to pick up, or local delivery issues, refund eligibility will be determined by our Shipping Policy and Refund Policy.
Kawaii Stop LLC is not responsible for carrier delays, customs delays, customs fees, import duties, local delivery restrictions, incorrect addresses, failed delivery attempts, refused deliveries, package theft after delivery, or loss after carrier-confirmed delivery, except where required by law or expressly provided in our posted policies.
9. RETURNS, REFUNDS, EXCHANGES, AND CANCELLATIONS
Returns, refunds, exchanges, cancellations, final sale items, damaged items, incorrect items, and order issues are governed by our Refund Policy, which is incorporated into these Terms by reference.
By placing an order, you agree to review and follow our Refund Policy before requesting a return, refund, exchange, cancellation, replacement, store credit, or other remedy.
Certain items may be final sale, non-returnable, custom-made, made-to-order, hygienic, intimate, seasonal, clearance, supplier-restricted, or otherwise ineligible for return or refund.
Cancellation requests are not guaranteed. Orders may begin processing shortly after purchase, and cancellation eligibility depends on the order status, supplier status, fulfillment stage, product type, and our Refund Policy.
If a cancellation request is submitted after processing, sourcing, production, customization, or shipment has begun, the order may not be eligible for cancellation or full refund.
Refunds, if approved, may be issued to the original payment method, store credit, gift card, replacement, exchange, or another remedy permitted under our posted policies.
Original shipping charges, customs fees, route/shipping protection fees, processing fees, payment processing fees, restocking fees, and other non-refundable charges may be excluded from refunds where permitted by law and disclosed in our policies.
10. PAYMENT DISPUTES, CHARGEBACKS, AND FRIENDLY FRAUD
If you believe there is an issue with your order, payment, product, delivery, return, refund, exchange, cancellation, or account, you agree to contact Kawaii Stop LLC first and provide us a reasonable opportunity to investigate and resolve the matter before initiating a chargeback, payment dispute, payment reversal, fraud claim, unauthorized transaction claim, or similar claim with a bank, card issuer, payment processor, payment provider, financial institution, or third party.
Failure to contact Kawaii Stop LLC before initiating a payment dispute may be considered by an arbitrator or court, to the fullest extent permitted by applicable law, when determining whether a party acted reasonably or in good faith.
Kawaii Stop LLC reserves the right to investigate, respond to, contest, defend, challenge, and submit evidence regarding any payment dispute, chargeback, reversal, fraud claim, unauthorized transaction claim, or similar claim.

Submitting a payment dispute, chargeback, reversal, fraud claim, unauthorized transaction claim, or similar claim that is knowingly false, misleading, abusive, inconsistent with order records, inconsistent with delivery records, inconsistent with customer communications, initiated after receiving the benefit of the transaction, or otherwise made to improperly avoid payment may constitute friendly fraud, payment abuse, breach of contract, unjust enrichment, or other legally actionable conduct depending upon the facts and applicable law.
Nothing in this Section limits a customer's right to pursue a legitimate payment dispute where such rights are provided by applicable law or payment network rules. This Section is intended solely to address false, abusive, misleading, fraudulent, or otherwise improper payment disputes.
Continuation of Contract
A chargeback, payment dispute, reversal, fraud claim, unauthorized transaction claim, or similar action does not automatically cancel, rescind, terminate, invalidate, or otherwise extinguish the underlying purchase agreement or any obligations arising under these Terms unless required by applicable law.
All contractual obligations remain in full force and effect unless otherwise required by law.
Recovery Rights
To the fullest extent permitted by applicable law, Kawaii Stop LLC reserves all rights to pursue recovery of:

unpaid purchase amounts;

chargeback losses;

payment processor fees;

administrative costs;
-
collection costs;
-
investigation costs;
-
filing fees;
-
arbitration fees;

court costs;
-
service of process fees;

subpoena costs;

expert witness fees;

reasonable attorney's fees where recoverable;

shipping losses;
-
product losses;
-
fulfillment costs;
-
customs-related losses;
-
and any other damages, costs, or remedies recoverable under contract or applicable law.
Nothing in this Section limits Kawaii Stop LLC's right to pursue arbitration, litigation, debt collection, collection agency referral, negotiated settlement, or any other lawful remedy available under these Terms or applicable law.
Assignment
Kawaii Stop LLC may assign or transfer delinquent accounts, unpaid balances, judgments, contractual claims, or collection rights to attorneys, licensed collection agencies, debt recovery providers, successors, assigns, or other authorized third parties for collection, enforcement, or recovery purposes.
Preservation of Rights
No payment dispute, chargeback, reversal, fraud claim, or similar proceeding shall be interpreted as a waiver of Kawaii Stop LLC's contractual rights, legal remedies, collection rights, arbitration rights, venue rights, reimbursement rights, or any other rights available under these Terms or applicable law.
11. PROMOTIONS, DISCOUNTS, AND FINAL SALE ITEMS
Promotions, discounts, coupon codes, giveaways, sales, gift cards, store credits, and special offers are subject to the terms stated at the time of the offer.
Promotions may be modified, limited, or discontinued at any time unless otherwise prohibited by law.
Discount codes may not be combined unless expressly stated.
Certain items may be marked as final sale, non-returnable, non-refundable, or exchange-only.
Giveaways, contests, sweepstakes, or promotional events may be governed by separate terms and conditions posted on the applicable promotion page.
12. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than the purpose for which we make the Services available.
You agree not to:
- Use the Services for fraudulent, abusive, illegal, or unauthorized purposes;
- Submit false order information, false payment information, false refund claims, false return claims, false chargebacks, or false delivery claims;
- Attempt to obtain a refund, replacement, store credit, reversal, or financial benefit through misleading, incomplete, false, or abusive conduct;
- Misrepresent order issues, delivery status, product condition, product use, payment authorization, or customer identity;
- Interfere with site security, functionality, or operations;
- Circumvent security features or fraud prevention tools;
- Use bots, scrapers, crawlers, automated scripts, or data extraction tools without written permission;
- Copy, scrape, reproduce, or exploit product data, content, images, descriptions, pricing, or website materials;
- Upload or transmit viruses, malware, spyware, or harmful code;
- Harass, abuse, threaten, intimidate, or mistreat our employees, contractors, support agents, partners, or suppliers;
- Submit false reports of abuse, misconduct, fraud, delivery failure, or product defects;
- Use the Services in a way that violates applicable laws or regulations;
- Attempt to impersonate another person or use another person’s payment method without authorization;
- Use the Services to compete with us or exploit our content commercially;
- Use a buying agent, reseller, or purchasing agent where we prohibit such activity;
- Engage in conduct that creates an unreasonable burden on our systems, staff, support operations, payment processors, suppliers, or logistics providers; or
- Otherwise violate these Terms or any posted policy.
We reserve the right to investigate, restrict, suspend, cancel, block, or terminate accounts, orders, or access where we believe a violation has occurred.
13. REVIEWS, USER CONTENT, AND SUBMISSIONS
The Services may allow you to submit reviews, comments, photos, videos, messages, suggestions, feedback, questions, or other content.
By submitting content to us or through the Services, you represent that:
- The content is accurate and not misleading;
- You have the rights necessary to submit it;
- The content does not infringe any third-party rights;
- The content does not contain unlawful, abusive, obscene, defamatory, threatening, harassing, or discriminatory material; and
- The content does not violate these Terms.
By submitting reviews, photos, videos, feedback, comments, or other content, you grant Kawaii Stop LLC a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, publish, display, modify, distribute, and create derivative works from such content for business, customer service, operational, marketing, advertising, legal, and promotional purposes.
We may remove, edit, reject, or refuse to publish user content at any time and for any reason.
Reviews are not guaranteed to be posted and do not necessarily reflect the views of Kawaii Stop LLC.
You agree not to submit false, misleading, abusive, defamatory, or bad-faith reviews, including reviews intended to obtain a refund, replacement, store credit, discount, or other benefit through pressure or misrepresentation.
14. THIRD-PARTY WEBSITES AND CONTENT
The Services may contain links to third-party websites, apps, services, payment processors, logistics providers, social media platforms, tracking tools, or other third-party content.
We do not control and are not responsible for third-party websites, services, policies, content, accuracy, privacy practices, payment processing, shipping systems, or actions.
Your use of third-party services is governed by the terms and policies of those third parties.
Kawaii Stop LLC is not responsible for losses, delays, fees, errors, or damages caused by third-party websites, payment processors, carriers, suppliers, customs authorities, apps, plugins, or platforms, except where required by law.
15. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to:
- Monitor the Services for violations of these Terms;
- Investigate suspected fraud, abuse, misuse, chargeback abuse, or policy violations;
- Take legal action where appropriate;
- Refuse, cancel, limit, or restrict orders;
- Suspend, terminate, or restrict accounts;
- Remove, edit, or disable content;
- Block certain IP addresses, devices, users, or regions where necessary;
- Report unlawful or abusive conduct to payment processors, fraud prevention services, law enforcement, or legal authorities where appropriate; and
- Manage the Services in a manner designed to protect our rights, customers, payment systems, staff, suppliers, and operations.

18. TERM AND TERMINATION

We reserve the right, in our sole discretion and without notice or liability, to deny access to the Services, suspend accounts, cancel orders, block users, or terminate accounts for any reason permitted by law, including but not limited to:

- Fraud or suspected fraud;
- Payment abuse;
- Chargeback abuse;
- False claims;
- Harassment or abuse of staff;
- Misuse of customer support;
- Unauthorized use of the Services;
- Security risks; or
- Conduct that creates operational, financial, legal, or reputational risk for Kawaii Stop LLC.
If your account is terminated or suspended, you may not create another account using your name, a false name, another person’s name, or another account without our written consent.
Termination does not limit any rights or remedies available to Kawaii Stop LLC, including recovery of unpaid amounts, fees, losses, chargeback costs, legal costs, or other damages.
19. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, suspend, discontinue, or remove all or part of the Services at any time and for any reason, without notice, unless required by law.
We do not guarantee that the Services will be available at all times.
The Services may experience interruptions, delays, errors, technical issues, maintenance, outages, app failures, supplier issues, payment processor issues, or carrier-related interruptions.
We are not liable for any loss, damage, delay, inconvenience, or inability to access or use the Services caused by interruptions, errors, downtime, or service changes.
We may update these Terms from time to time by posting a revised version with an updated “Last Updated” date.
Your continued use of the Services after updated Terms are posted constitutes acceptance of the updated Terms.
20. GOVERNING LAW
These Terms, the Services, all purchases, orders, refunds, returns, exchanges, cancellations, payment disputes, chargebacks, communications, and all other matters arising out of or relating to Kawaii Stop LLC shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to any conflict of law principles that would require application of another jurisdiction's laws.
To the fullest extent permitted by applicable law, the parties expressly agree that Illinois law shall govern the interpretation, validity, enforcement, and performance of these Terms regardless of the customer's location, residence, place of purchase, payment method, delivery destination, or any other connecting factor.
Nothing in this section limits any mandatory consumer protection rights that cannot legally be waived under applicable law.
21. DISPUTE RESOLUTION, ARBITRATION, VENUE, AND LEGAL PROCEEDINGS
Informal Resolution
The parties agree to attempt to resolve any dispute informally before commencing arbitration or litigation. A party asserting a dispute shall provide written notice describing the nature of the dispute and the requested resolution. The receiving party shall have at least thirty (30) days to investigate and respond before arbitration or litigation is initiated, unless immediate relief is required by law.
Nothing in this section prevents either party from seeking temporary injunctive relief where such relief is legally available.
Mandatory Individual Arbitration
Except where prohibited by applicable law or where a claim properly falls within the jurisdiction of a court authorized to hear such claims without arbitration, any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the Services, any purchase, payment, order, refund, exchange, cancellation, delivery, customer support interaction, payment dispute, chargeback, or relationship between the parties shall be resolved exclusively through final and binding individual arbitration.
Arbitration shall be administered by the American Arbitration Association ("AAA") under the Consumer Arbitration Rules then in effect unless the parties mutually agree otherwise.
The arbitrator shall have exclusive authority to determine the scope, interpretation, applicability, enforceability, and validity of this arbitration agreement except where applicable law provides otherwise.
Judgment upon any arbitration award may be entered in any court having jurisdiction.
Individual Proceedings Only
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL CLAIMS SHALL BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY.
NO PARTY MAY PARTICIPATE AS A PLAINTIFF, CLAIMANT, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, REPRESENTATIVE, OR MEMBER OF ANY CLASS ACTION, MASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, COORDINATED ACTION, CONSOLIDATED ACTION, OR SIMILAR PROCEEDING.
THE ARBITRATOR SHALL HAVE NO AUTHORITY TO CONSOLIDATE CLAIMS OR AWARD RELIEF TO PERSONS WHO ARE NOT PARTIES TO THE ARBITRATION.
Exclusive Venue
To the fullest extent permitted by applicable law, the parties irrevocably consent and submit to the exclusive jurisdiction of the state and federal courts located in or serving Cook County, Illinois for:

enforcement of arbitration awards;

proceedings permitted outside arbitration;

temporary or permanent injunctive relief;
-
debt collection actions;
-
enforcement of these Terms;
-
actions involving intellectual property;
-
and any proceeding for which arbitration is unavailable or unenforceable.
Each party knowingly and voluntarily waives any objection based upon:

lack of personal jurisdiction;

improper venue;
-
inconvenient forum;
-
forum non conveniens; or
-
any substantially similar doctrine,
to the fullest extent permitted by applicable law.
Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVES ANY RIGHT TO TRIAL BY JURY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PURCHASE.
Costs and Fees
Except where prohibited by applicable law or the applicable arbitration rules, the arbitrator may award costs, expenses, arbitration fees, filing fees, reasonable attorney's fees where recoverable, expert witness fees, investigation costs, collection costs, and other recoverable litigation expenses to the prevailing party or as otherwise authorized by contract, applicable law, or the applicable arbitration rules.
Nothing in this Section requires an award of attorney's fees where prohibited by law.
Limitation Period
To the fullest extent permitted by applicable law, any claim arising out of or relating to these Terms, the Services, or any purchase must be commenced within one (1) year after the claim first arose unless a longer period is required by applicable law.
Severability
If any provision of this Section is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
If the prohibition on class, collective, coordinated, representative, consolidated, or similar proceedings is determined to be unenforceable with respect to a particular claim, only that specific claim shall proceed in a court of competent jurisdiction, while all remaining provisions of this Section shall remain enforceable to the fullest extent permitted by law.
Survival
This Section shall survive termination of the Services, closure of any customer account, cancellation of an order, completion of a transaction, issuance of a refund, or termination of these Terms and shall continue to govern any dispute arising out of or relating to the parties' relationship.
22. CORRECTIONS
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including product descriptions, pricing, promotions, shipping times, availability, sizing, images, product details, or other information.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after an order has been submitted.
We reserve the right to cancel, reject, or modify an order affected by an error where permitted by law.
23. DISCLAIMER
THE SERVICES AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE FULLEST EXTENT PERMITTED BY LAW, KAWAII STOP LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND ERROR-FREE OPERATION.
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
WE DO NOT GUARANTEE THAT PRODUCT IMAGES, COLORS, SIZING, MEASUREMENTS, PACKAGING, MANUFACTURING DETAILS, OR SUPPLIER INFORMATION WILL BE PERFECTLY ACCURATE OR IDENTICAL TO WHAT APPEARS ON YOUR SCREEN.
WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES, PAYMENT PROCESSORS, SHIPPING CARRIERS, CUSTOMS AUTHORITIES, SUPPLIERS, APPS, PLUGINS, OR EXTERNAL WEBSITES.

24. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KAWAII STOP LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY SINGLE ORDER, TRANSACTION, PURCHASE, PRODUCT, SERVICE, OR CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE CUSTOMER TO KAWAII STOP LLC FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED, INCLUDING CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, RESTITUTION, UNJUST ENRICHMENT, CONSUMER PROTECTION, EQUITY, STATUTE, OR OTHERWISE, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KAWAII STOP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, ENHANCED, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST INCOME, LOST BUSINESS OPPORTUNITIES, LOST DATA, LOSS OF GOODWILL, LOSS OF USE, EMOTIONAL DISTRESS, INCONVENIENCE, OR OTHER NON-DIRECT DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
KAWAII STOP LLC SHALL NOT BE LIABLE FOR LOSSES OR DAMAGES ARISING FROM:
- Carrier delays;
- Customs delays;
- Customs duties, taxes, brokerage fees, or import charges;
- Government inspections or import restrictions;
- Incorrect shipping information provided by the customer;
- Delivery to the address provided by the customer;
- Failed delivery attempts;
- Refused deliveries;
- Failure to retrieve a package;
- Package theft or loss after carrier-confirmed delivery;
- Minor manufacturing variations;
- Color, texture, stitching, sizing, packaging, or batch variations;
- Supplier manufacturing changes;
- Customer failure to review product descriptions, measurements, size charts, processing times, or posted policies;
- Temporary website interruptions;
- Third-party payment processor failures;
- Third-party carrier failures;
- Third-party supplier failures;
- Events beyond our reasonable control; or
- Any circumstance expressly addressed by our Refund Policy, Shipping Policy, or other incorporated policies.
Nothing in this Section limits liability that cannot legally be excluded or limited under applicable law.
Where applicable law does not permit the exclusion or limitation of certain damages, the foregoing limitations shall apply to the maximum extent permitted by law.
25. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Kawaii Stop LLC, together with its members, managers, officers, employees, contractors, suppliers, affiliates, licensors, successors, assigns, agents, and representatives, from and against any and all claims, demands, actions, proceedings, investigations, damages, judgments, settlements, liabilities, penalties, losses, costs, and expenses arising out of or relating to:

- Your violation of applicable law;
- Your violation of the rights of another person or entity;
- Your reviews, submissions, communications, or user content;
- Any false, misleading, abusive, fraudulent, or improper payment dispute, chargeback, reversal, unauthorized transaction claim, refund request, return request, delivery claim, or similar claim;
- Any inaccurate billing, shipping, payment, or account information you provide;
- Your refusal of delivery, abandonment of a shipment, or failure to pay customs or import charges where applicable;
- Your misuse of customer support;
- Your harassment, abuse, or threats directed toward Kawaii Stop personnel, suppliers, contractors, or partners; or
- Any conduct that causes Kawaii Stop LLC to incur legal, financial, operational, reputational, or administrative loss.
Recoverable costs may include, to the fullest extent permitted by applicable law:
- Reasonable attorney's fees where recoverable;
- Arbitration fees;
- Court costs;
- Filing fees;
- Investigation costs;
- Expert witness fees;
- Service of process fees;
- Subpoena costs;
- Collection costs;
- Chargeback fees;
- Payment processor fees;
- Shipping losses;
- Product losses;
- Administrative expenses; and
- Any other recoverable damages or expenses permitted by contract or applicable law.
Kawaii Stop LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification, and you agree to reasonably cooperate with such defense.
26. USER DATA
We may maintain certain data that you transmit to the Services for the purpose of managing orders, customer support, account access, fraud prevention, chargeback responses, legal compliance, analytics, and operation of the Services.
Although we may perform backups or use third-party platforms to store data, you are responsible for maintaining your own records of orders, communications, policies, and transactions.
We are not liable for loss, corruption, deletion, or unavailability of user data except where required by law.
27. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting the Services, creating an account, placing an order, submitting payment, communicating with customer support, accepting policies, submitting forms, clicking buttons, sending emails, participating in chat, or otherwise communicating electronically with Kawaii Stop LLC constitutes electronic communications.
You consent to receive communications electronically, including order confirmations, receipts, invoices, shipping updates, customer support responses, refund decisions, legal notices, policy updates, and other communications relating to the Services.

- Other electronically stored information reasonably related to the transaction.
To the fullest extent permitted by applicable law, such records may be relied upon as business records and evidence in arbitration, litigation, payment disputes, chargeback proceedings, debt collection actions, or other legal proceedings.

29. MISCELLANEOUS
These Terms, together with the Refund Policy, Shipping Policy, Privacy Policy, product page disclosures, checkout disclosures, promotions, final sale notices, processing time disclosures, and all other policies incorporated by reference, constitute the complete agreement between you and Kawaii Stop LLC concerning the Services.
Continued communications with Kawaii Stop LLC following delivery, including requests for customer support, returns, refunds, exchanges, replacements, warranty assistance, sizing assistance, order modifications, or similar post-purchase assistance, shall constitute continued affirmation of these Terms and shall not invalidate or revoke your acceptance of this Agreement.
Headings are provided solely for convenience and shall not affect interpretation of these Terms.
Our failure to exercise or enforce any right or provision shall not constitute a waiver of that right or provision.
Any waiver must be in writing and signed by an authorized representative of Kawaii Stop LLC.
We may assign or transfer any of our rights, obligations, claims, collection rights, judgments, contractual rights, or business interests, in whole or in part, including in connection with a merger, acquisition, restructuring, financing, asset sale, business transition, collection activity, or enforcement of these Terms.
You may not assign your rights or obligations under these Terms without our prior written consent.
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
Nothing contained in these Terms creates any partnership, joint venture, employment, agency, franchise, fiduciary, or similar relationship between you and Kawaii Stop LLC.
These Terms shall not be construed against Kawaii Stop LLC solely because we drafted them.
Fees and Costs
To the fullest extent permitted by applicable law, if Kawaii Stop LLC takes action to collect unpaid amounts, enforce these Terms, respond to improper payment disputes, recover losses caused by chargebacks, or defend claims arising from false, misleading, abusive, or fraudulent conduct, Kawaii Stop LLC may seek recovery of all costs and expenses recoverable under applicable law, including reasonable attorney's fees where recoverable, arbitration fees, filing fees, court costs, collection costs, investigation costs, expert witness fees, subpoena costs, administrative expenses, and payment processor fees.
Force Majeure
Kawaii Stop LLC shall not be liable for delays, failures, interruptions, or inability to perform resulting from events beyond our reasonable control, including natural disasters, severe weather, acts of God, war, terrorism, civil unrest, labor disputes, pandemics, epidemics, cyberattacks, utility failures, internet outages, carrier delays, customs delays, supplier failures, payment processor outages, governmental actions, or similar events beyond our reasonable control.
Survival
Any provision which by its nature should survive termination shall survive, including but not limited to payment obligations, chargeback provisions, dispute resolution, arbitration, governing law, venue, limitation of liability, indemnification, intellectual property rights, licenses, electronic records, collection rights, and all rights and remedies available under these Terms.
